A group of Japanese hackers have already cracked the Nintendo 3DS and figured out how to get an R4 cartridge working. (An R4 is a modified game cartridge that allows you to play homebrew and backups of NDS games.)

You know, fixing the homebrew problem is so easy for developers.
Just include a small asian man with your purchase who will look over you and make sure you only play games that you have legally bought. Simple.
