In the Netherlands that would be completely legal since it is just one plant. One plant is seen as personal use. Pretty sure the couple had no idea what plant it was.

Same kinda story happened to my grandmother, my uncle gave her the plants, she grew them, realised they were pot, she sold them to someone else :troll:
